“飘柔”商标可以注册在“毛巾”商品上吗?
近日,天津市泽鸣贸易有限公司和宝洁公司因“飘柔”商标产生纠纷,天津市泽鸣贸易有限公司作为原告将国家知识产权局、第三人宝洁公司诉至知产法院,知产法院依法审理了这起商标无效宣告行政纠纷案件,并裁定驳回原告诉讼请求,对第三人宝洁公司的“飘柔”商标予以保护。

国际商标协会著名及驰名商标委员会(FWKMC)美国分会更新了美国商标淡化判例数据库,更新后的数据库收录了2010-2016年间的约80份涉及商标知名度实体认定的TTAB决定。在这些TTAB案件中,有29%的案件认定异议申请人的商标有知名度,此外,有11%的案例,认定有知名度的商标遭受了商标淡化。也就是说,在异议申请人的商标被认定为有知名度的案例中,超过三分之一的案例同时也认定了商标淡化。那么,商标知名度是否能够视为影响商标淡化判定的因素呢,这就需要原告提交大量具有实质意义的证据,证明其商标在异议商标申请日之前的知名度,这样才能使商标淡化的主张得到支持。
广州“茶颜观色”商标持有方洛旗公司(以下简称“原告”)于2019年将奶茶品牌“茶颜悦色”告上法庭,诉其商标侵权。2020年4月8日,该案由长沙市岳麓区人民法院一审宣判,“茶颜悦色”胜诉,原告方的全部诉讼请求被驳回。
